BY PURCHASING YOU AGREE TO THE FOLLOWING TERMS AND CONDITIONS
NaShoba Properties Inc. is a licensed real estate brokerage in Massachusetts and New Hampshire. It is a flat-fee limited service company. It does not provide the same services as a "traditional" brokerage. We do not represent any buyer or seller unless agreed upon in writing. We do not guarantee that you will be able to control what your listing says or how your listing will be displayed on the MLS or any other web site that may have your house listed as a result of your listing on the MLS. NaShoba Properties Inc. shall not have liability or responsibility regarding the information contained within this web site, MLS or any other source including any information provided by sellers regarding properties listed anywhere. Buyers are to independently verify the accuracy and completeness of all information contained within each property advertised wherever listed. Conversely, you are paying a reduced flat fee rather than the more common percentage fee typically charged by full-service brokerages. NaShoba Properties Inc. provides these services only as a Non Agent/Facilitator. TNaShoba Properties Inc. does not owe you any fiduciary or other duty.NaShoba Properties Inc. does not actually represent you. NaShoba Properties Inc. will provide such Ministerial Acts as stated Such acts may include one or more of the following: submitting the information you provide to the multiple listing service directory; providing you None of the Ministerial Acts performed by NaShoba Properties Inc. shall be constructed in such a manner as to form a brokerage engagement with you. NaShoba Properties Inc. does not provide assistance in any manner that would require it or its principles to exercise discretion or judgment. Examples of services that are not provided include: suggesting a sales price; negotiating with property.
You may cancel your listing at any time. If you cancel your listing before our documentation is submitted to MLS or cancel the product purchase before they are shipped, you will be charged a transaction fee of $20 which will be deducted from the purchase price and you will ONLY receive the remaining $ amount as a refund. There are no refunds on products once shipped or on listings once entered in MLS. Once our documents and your photographs are submitted to us, your property will be listed the same day if received by 1:00 P.M. Eastern Standard Time. If we receive our documents and photographs after 1:00 P.M. Eastern Standard Time or on the weekend, your property will be posted the next business day. Changes to an MLS listing are handled in the same fashion. If service is not available in your area you will receive a full refund. Our normal busniness hours are Monday - Friday, 9 AM - 5 PM. (EST).
NaShoba Properties Inc. works to maintain its web site and services, but is not responsible for defects that may exist within its web site or any resulting loss of profits or other damages. NaShoba Properties Inc. attempts to accurately enter the information you provide into the multiple listing service. However, NaShoba Properties Inc. does not guarantee error-free service. If you discover any error you must promptly notify NaShoba Properties Inc. so the error can be remedied. NaShoba Properties Inc. is not responsible for any loss or damage suffered by the error. NaShoba Properties Inc. shall under no circumstances have any liability greater than the amount it received from you for its services less any discount provided by NaShoba Properties Inc..You agree to hold NaShoba Properties Inc. harmless from any and all claims, causes of action, or damages arising out of or relating to your providing incomplete and/or inaccurate information to NaShoba Properties Inc.. Seller hereby releases NaShoba Properties Inc. and those working through NaShoba Properties Inc. from all liability and responsibility in connection with any loss that may occur.
There have been isolated instances of reported burglaries of homes on which lockboxes have been placed and for which the lockbox has been alleged to have been used to access the home. In order to minimize the risk of misuse of the lockbox NaShoba Properties Inc. recommends against the use of lockboxes on door handles that can be unscrewed from the outside or on other parts of the home from which the lockbox can be easily removed. Since others will have access to your property you should remove all valuables or put them in a secure place.
In using this site and the services offered herein, you agree to hold harmless the officers, directors, employees, business partners of any kind, agents and real estate agent affiliates for damages arising out of or in connection with the use of this web site and service or any third party site herein. This is a complete limitation of liability that applies to all damages of any and every kind, including, but not limited to, compensatory, direct, indirect or consequential damages, loss of data, income or profit, loss of or damage to property, personal injury, and claims of third parties. Users, business partners and advertisers hereby release and discharge NaShoba Properties Inc. and its owner, officers, directors, employees and agents for any and all claims pertaining to the use in any way of this site and any third party site/content/service referenced herein, expressly including without limitation any claim of negligence against NaShoba Properties Inc. or its owner, officers, directors, employees, agents or real estate agent affiliates. NaShoba Properties Inc. is not responsible for the content of any off-site pages or any other sites linked to this site. Your linking to off-site pages or other sites is at your own risk.
Selling and buying real estate is a very serious endeavor and can have serious legal consequences. As such, we encourage all parties to ALWAYS CONSULT AN ATTORNEY. Furthermore, we encourage and support an affirmative advertising and marketing program in which there are no barriers to obtaining housing based on race, color, religion, sex, handicap, familial status, national origin or any other reason.
When you accept an offer on your property you agree to notify NaShoba Properties Inc. within 24 hours by email or fax a copy to 978 361 2013. The failure to do so will result in a fine to NaShoba Properties Inc. by the MLS, which will be charged directly to the seller.
The information provided in this site are meant for customers and potential customers of NaShoba Properties Inc. interested in buying and selling real estate, and agents who represent buyers interested in buying properties listed by NaShoba Properties Inc. for the sole purpose of selling properties listed by NaShoba Properties Inc.. Use of the information provided in this website for any other purpose is not permitted.
Changes to our conditions of use
From time to time, it may be necessary for us to change this Policy. We reserve the right at our discretion to modify this Policy at any time without PRIOR NOTICE.
